Gabb Wireless (“Gabb Life” “we,” “our,” and/or “us”) values your child’s privacy. When your child participates in a Gabb Life contest, this privacy notice (the “Gabb Life Contest Children’s Privacy Notice”) explains how we collect, use, and share information from your child. We will only collect and use your child’s personal information that is not subject to an exception under the Children’s Online Privacy Protection Act when we have the consent of the child’s parent or guardian. We collect the following information from your child when they enter a Gabb Life contest:
Contest Registration and Entry. When your child enters one of our contests, and you consent to their participation, we ask your child to provide their first name, initial of last name, date of birth, email address, phone number, and the city and state where they reside. If your child signs up using a third-party account, we will also receive your child’s submission title, submission description, email address, phone number, city, and state from that third-party account. As part of the contest entry, your child will also provide us with a video of themselves participating in an activity related to the contest (such as surfing, skateboarding, singing, etc.).
Device and Usage Information. When your child accesses our website to submit their contest entry, we receive information about the device and software they use to access our website, including internet protocol (IP) address, web browser type, operating system version, phone carrier and manufacturer, and device identifiers. We also automatically receive information about your child’s interactions with our website, like the pages or other content they view and the dates and times of their visits.
Information from Cookies and Similar Technologies. We and third party partners collect information using cookies, pixel tags, or similar technologies. Cookies are small text files containing a string of alphanumeric characters.
We use the information we collect from your child:
We do not share or otherwise disclose information about your child except as described below.
Contest Entries. The following information from your child’s contest entry will be publicly posted on the Gabb Life website: first name and last initial, the city and state where your child resides, the video your child uploads and any content or information contained within that video. This information will remain public until we choose to remove it from our website.
Vendors and Service Providers. We share your child’s information with vendors and service providers retained in connection with the provision of our Services. For example, we partner with Gigg to provide services related to our contests.
As Required by Law and Similar Disclosures. We may access, preserve, and disclose your information if we believe doing so is required or appropriate to: (a) comply with law enforcement requests and legal process, such as a court order or subpoena; (b) respond to your requests; or (c) protect your, our, or others’ rights, property, or safety. For the avoidance of doubt, the disclosure of your information may occur if you post any objectionable content on or through the Services.
Merger, Sale, or Other Asset Transfers. We may disclose and transfer your information to service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company or we sell, liquidate, or transfer all or a portion of our business or assets.
